Legal Ways Out of a Lease
A lease is a contract for its full term — but several exits are recognized almost everywhere:
- An early-termination clause — many leases price the exit up front (commonly a fee of one to two months' rent plus notice). If the lease agreement has one, follow it exactly.
- Military orders — the federal SCRA lets active-duty servicemembers terminate with written notice and a copy of orders.
- Uninhabitable conditions or landlord breach — serious, documented habitability failures can justify termination (get legal advice first; the bar is high).
- State-specific protections — many states allow early termination for domestic-violence survivors, and some for medical or elderly-care moves.
- Mutual agreement — the most common exit in practice: both sides agree on a date and terms, and sign a termination agreement. No statute needed.
Outside these, a tenant who leaves early generally stays liable for rent until the unit re-rents — most states require the landlord to make reasonable re-rental efforts rather than let the unit sit and bill the departed tenant.

Getting It Right
- Prorate the final month. If termination lands mid-month, the prorated rent calculator gives the exact figure to write into the agreement.
- Settle the deposit in writing. The agreement should say how and when the deposit comes back — the security deposit guide covers the state-law deadlines that still apply, and the itemization goes out as a security deposit return letter.
- Keep the money trail. Final rent, fees, and the deposit return all belong on the rent ledger — terminations are exactly when clean records get tested.
