What a Notice to Vacate Must Include

  • The date of the notice — starts the notice-period clock — it's the most legally important line on the page.
  • Property address and unit — ties the notice to a specific tenancy.

Check the lease and your state's minimum notice period before dating the letter — 30 days is the most common floor for month-to-month tenancies, but several states require 60, and fixed-term leases set their own terms.

Getting the Details Right

  • Count the notice period from delivery, not signing. If the lease requires 30 days, the move-out date must be at least 30 days after the notice is actually received/served.
  • Deliver it provably. Personal delivery with a witness, certified mail, or a lease-approved electronic channel. Keep the dated copy and the proof.
  • Landlords: mind anti-retaliation and just-cause rules. Some cities and states limit when a landlord may end a tenancy or require a stated reason. Verify before serving notice.
  • Prorate the last month if it ends mid-month — the prorated rent calculator gives the exact figure.
  • Late rent is a different document. If the issue is unpaid rent, send a late rent notice (or your state's pay-or-quit form), not a notice to vacate.
  • Breaking a lease early is also a different document. Ending a fixed-term lease before its end date — by agreement or legal right — calls for a lease termination letter, not standard notice.

What is a notice to vacate?
A notice to vacate is a written statement that a tenancy is ending on a specific date. It runs in either direction: a tenant sends one to tell the landlord they're moving out, or a landlord sends one to tell the tenant the tenancy will not continue (for example, at lease end or to end a month-to-month arrangement). It is not an eviction — it's the routine, required first step of ending a tenancy properly.
How much notice is required — 30 or 60 days?
It depends on your lease and your state. Month-to-month tenancies most commonly require 30 days' written notice from either side, but several states require 60 days (sometimes only from the landlord, or only after the tenant has lived there a certain time). Is a notice to vacate the same as an eviction notice?
No. A notice to vacate ends a tenancy in the ordinary course — no allegation of wrongdoing, just the tenancy running its course or a month-to-month arrangement being ended. An eviction notice (like a pay-or-quit or cure-or-quit notice) alleges a lease violation and starts a legal process that can end in a court-ordered removal. Using the right document matters: courts will toss an eviction built on the wrong notice.
How should a notice to vacate be delivered?
In writing, by a method you can prove. Many states specify acceptable service methods — personal delivery, certified mail, or posting plus mailing are typical. Email or a portal message may be valid if the lease allows written electronic notice. Whatever the method, keep a dated copy and proof of delivery; the notice date starts the clock, so being able to prove it is the whole point.
Can a tenant retract a notice to vacate?
Only if the landlord agrees. Once delivered, a notice to vacate is generally binding — the landlord may have relisted the unit or signed a new lease relying on it. If plans change, ask in writing as early as possible; if the landlord agrees to continue the tenancy, document that in writing too.
Does a tenant owe rent after giving notice?
Yes — rent is owed through the end of the notice period (or lease term), whether or not the tenant leaves earlier.
